A firm protested an Army contract award for water pumping assemblies, contending that the Army should terminate the contract, since it improperly: (1) omitted certain mandatory drug-free workplace clauses from the solicitation; and (2) failed to incorporate the clauses into the contract before award. GAO held that the Army did not need to terminate the contract, since the: (1) omission was not prejudicial to bidders; (2) awardee did nothing to disqualify itself; and (3) Army obtained the certification and modified the contract shortly after award. Accordingly, the protest was denied.
