A firm protested a Navy contract award for a digital signal processor, contending that the: (1) Navy improperly awarded the contract at a high price without discussions; (2) Navy improperly used an unannounced evaluation factor; (3) awardee's proposal was technically unacceptable; and (4) awardee's equipment did not meet the solicitation requirements. GAO held that the: (1) Navy properly awarded the contract without discussions, since the protester was no longer in the competitive range because its proposal was technically unacceptable; (2) Navy's evaluation was consistent with the stated evaluation criteria; (3) awardee's proposal complied with the solicitation requirements; and (4) allegation concerning the awardee's offered equipment was without merit, since the awardee offered conforming equipment. Accordingly, the protest was denied.
