[Decision Concerning Liability for Damages to Rental Vehicle]

The Per Diem, Travel, and Transportation Allowance Committee requested a decision regarding a Marine Corps member's liability for damage to a rental car. The Committee advised that the member: (1) received authorization to rent a car during temporary additional duty travel; (2) provided the car keys to two enlisted men, who subsequently gave the keys to another member who damaged the car while using it for other than official purposes; and (3) submitted a supplemental travel voucher to cover the damages, requesting that the government directly pay the rental agency on his behalf. GAO held that the government could make direct payment to the car rental agency on behalf of the authorized renter, who was not at fault for the damages. Accordingly, the Committee should: (1) determine whether the authorized renter's insurance carrier paid the car rental agency; and (2) pursue reimbursement for the payment from the driver who caused the damage.
