The Army requested an advance decision concerning a civilian employee's entitlement to military leave under temporary appointments. GAO held that the: (1) claimant was not entitled to military leave, since authorizing legislation limited military leave to employees serving temporary appointments of 1 year or more; and (2) new legislation allowing agencies to extend temporary appointments did not alter the claimant's military leave eligibility. Accordingly, the claim was denied.
