Highlights

A firm requested reconsideration of its dismissed protest against the Army's rejection of its bid. GAO had held that the protester untimely filed its comments on the Army's protest report more than 10 working days after GAO received the report. The protester contended that it timely filed its comments, since it: (1) received the report 4 days late; and (2) filed its comments within 10 working days of its receipt of the report. GAO held that the protester failed to note its late receipt of the report or indicate its continued interest in the protest within the required time period. Accordingly, the dismissal was affirmed.
