A motor carrier requested review of a General Services Administration (GSA) audit action that found that it overcharged the government for a shipment. GSA held that, since the claimant offered two versions of its tender rates, the lower rate was applicable under the shipment. The claimant contended that: (1) GSA improperly determined that a lower rate was applicable under its tender to another agency; and (2) the higher tariff rate was applicable, since the shipment exceeded a weight limit. GAO held that the lower tender rate was applicable, since the rate the claimant offered to another agency did not exclude other government agencies. Accordingly, the claim was denied.
