A firm protested the Department of Agriculture's (USDA) rejection of its bid for a fire detection system, contending that it failed to acknowledge a solicitation amendment because it did not receive the amendment and was not even aware of the amendment until after USDA rejected its bid. GAO held that USDA properly rejected the protester's bid as nonresponsive, since: (1) the protester failed to acknowledge a material solicitation amendment; and (2) there was no evidence that USDA deliberately excluded the protester from competition. Accordingly, the protest was dismissed.
