A firm protested the Panama Canal Commission's (PCC) rejection of its bid as nonresponsive under a brand-name-or-equal solicitation for oil switches, contending that: (1) PCC improperly determined that it qualified its bid; and (2) the switches it offered met the solicitation's salient characteristics. GAO held that: (1) the protest was academic, since PCC terminated the contract after discovering errors in its bid evaluation procedures; and (2) awarded the contract to the low responsive bidder. Accordingly, the protest was dismissed.
