A firm protested a proposed Navy contract award for shipping and storage containers, contending that the proposed awardee's bid was nonresponsive, since it did not obligate the awardee to furnish the correct number of containers added by a solicitation amendment. GAO held that the Navy improperly waived the proposed awardee's failure to include a price for the increased quantity, since the intended bid price did not represent a clear commitment to furnish the increased quantity at a specified price. Accordingly, the protest was sustained, and GAO recommended that the Navy reject the proposed awardee's bid as nonresponsive.
