A firm requested review of a General Services Administration (GSA) audit action to deduct an amount that the claimant allegedly overcharged the Marine Corps for transportation services, contending that GSA improperly applied the firm's tender, since the Corps' bill of lading did not refer to the tender, as required. GAO held that: (1) the tender required only vendors to refer to it; and (2) GSA properly determined that the word "vendor" did not apply to the government in most cases. Accordingly, the audit action was sustained.
