Highlights

A firm protested the Army's cancellation of a solicitation for research and development and subsequent resolicitation, contending that the Army: (1) did not justify its reason for cancelling the original solicitation; (2) should have conducted discussions with it, as the only offerer; and (3) should have included a patent license factor in the resolicitation. GAO held that the: (1) Army properly cancelled the solicitation, since the protester's bid significantly exceeded the funding limit; and (2) allegation concerning patent infringement was not within its bid protest authority. Accordingly, the protest was denied in part and dismissed in part.
