A firm protested a Defense Logistics Agency (DLA) solicitation for reflective tape for the Navy, contending that DLA should have awarded the contract to it on a sole-source basis, since: (1) it had been the only producer for the past 5 years; and (2) the Navy did not adequately test an approved alternate product. GAO would not consider the protest, since: (1) the protester untimely filed its protest more than 10 working days after notification of initial adverse action on its agency-level protest; and (2) it did not review contentions that agencies should make sole-source awards. Accordingly, the protest was dismissed.
