The Army requested a decision concerning a retired Army officer's claim for reimbursement for amounts deducted from his military retired pay for Survivor Benefit Plan annuity coverage for his former spouse. GAO held that the officer was not entitled to reimbursement for the deductions, since: (1) he and his former spouse executed a written agreement at the time of their divorce that provided for the benefits whether or not they were married at the time of his death; and (2) the Army properly determined that the written agreement established the officer's commitment to maintain his spouse's annuity coverage. Accordingly, the claim was denied.
