An ACTION employee appealed his denied claim for retained pay when he transferred from the Peace Corps to ACTION, contending that, since the Peace Corps granted him retained pay when he transferred to it from ACTION, ACTION should have done the same when he returned. GAO held that: (1) regulations precluded the claimant from retaining the grade or rate of pay he held during the temporary assignment; and (2) ACTION properly determined the claimant's pay rate based on his Peace Corps salary. Accordingly, the claim was denied.
