A firm requested reconsideration of its dismissed protest against an Army solicitation. GAO had held that the protester untimely filed its protest. In its request for reconsideration, the protester contended that: (1) it timely filed its GAO protest within 10 working days after initial adverse action on its agency-level protest; and (2) GAO should consider its protest on the merits. GAO held that the: (1) protester untimely filed its GAO protest more than 10 working days after the Army sent it a bid rejection letter and awarded the contract to another bidder; and (2) circumstances did not warrant waiver of protest timeliness requirements. Accordingly, the request for reconsideration was denied.
