[Protest of DLA Contract Award for Scoop Loaders]

A firm protested a Defense Logistics Agency (DLA) contract award for scoop loaders, contending that the: (1) awardee's product did not meet the solicitation's commercial-product and performance requirements; and (2) awardee did not intend to furnish the precise product it offered. GAO held that: (1) DLA reasonably determined from the descriptive literature that the awardee's product was acceptably modified and met all commercial-product and performance requirements; (2) the protester untimely filed its protest concerning performance requirements; and (3) the awardee's fulfillment of contract requirements was a matter of contract administration, which it would not review. Accordingly, the protest was denied.
