[Protest of Army Contract Award for Housing Maintenance]
Highlights
A firm protested an Army contract award for housing maintenance, contending that the Army improperly failed to: (1) send written confirmation of its oral requests for best and final offers (BAFO); (2) establish common BAFO receipt times and dates; (3) allow sufficient time for BAFO preparation; and (4) inform it of the opportunity to submit an offer. The protester also contended that the Army engaged in prohibited auction techniques. GAO held that, although the Army improperly failed to confirm its oral request for BAFO, it would not disturb the award, since the: (1) Army orally informed the protester of the time and date for receipt of BAFO; (2) protester failed to show that it untimely received this information or that the Army engaged in auction techniques; and (3) Army afforded the protester the same opportunity to compete as the other offerers. Accordingly, the protest was denied.
