GAO reviewed the Defense Logistics Agency's (DLA) authority to enter into a multiyear contract for the supply and storage of a sulfa drug. GAO held that: (1) DLA had no authority to enter into such a contract; (2) Congress had not appropriated funds for the purpose; and (3) inclusion in the contract of a clause concerning funding availability for the next fiscal year did not permit the use of annual funds for a multiyear procurement. Accordingly, DLA should seek specific authority from Congress to continue the contract beyond the current fiscal year.
