A firm requested reconsideration of the denial of its protest against the Army's failure to promptly forward its protest against another offerer's size status to the Small Business Administration (SBA). GAO had held that the protester untimely filed its protest. The protester contended that, since SBA reversed its original decision, the denial of its protest was improper. GAO held that: (1) since the protester untimely filed its protest, the SBA ruling did not affect its original decision; and (2) the protester failed to present any factual or legal errors in the original decision. Accordingly, the original decision was affirmed.
