The Air Force requested a decision concerning whether a retired officer could accept appointment as a reserve officer in the Air National Guard and receive compensation in his new position. GAO held that: (1) Air Force regulations precluded the appointment of retired military members to the Air National Guard, except to certain positions; (2) there were no federal statutes prohibiting the officer's acceptance of the appointment, provided that he met the eligibility standards; and (3) acceptance of the appointment would not be a basis for recomputation of the officer's retired military pay. Accordingly, the officer may accept the appointment.
