The Air Force requested a decision concerning the proper application of the statutes governing the recoupment of military allotments which were overpaid due to the allotter's death. GAO held that: (1) except in the case of insurance premiums, the statutes did not allow recoupment of erroneously paid allotments when the payment continued due to a delay in receipt of evidence of the allotter's death; and (2) the anti-recoupment provision applied to anyone that received an authorized allotment. Accordingly, the Air Force should apply the statutes' provisions in making recoupments.
