A firm protested under an Army solicitation for a computer-aided design system, contending that the: (1) Army failed to conduct meaningful discussions regarding its software licensing agreement; and (2) solicitation's liquidated damages clause subjected bidders to undue risk. GAO held that the protester untimely filed its protest after the closing date for receipt of final proposals. Accordingly, the protest was dismissed.
