A firm protested a Defense Personnel Support Center (DPSC) contract award to another firm for flying helmets, contending that DPSC improperly: (1) added a Buy American Act differential to its bid price; and (2) denied it a waiver of the differential, since it offered a domestic product. GAO held that: (1) it would not review the DPSC determination to deny the protester a waiver; and (2) DPSC properly refused to consider the protester's late modified proposal. Accordingly, the protest was denied in part and dismissed in part.
