A firm protested a Navy contract award to another firm under a two-step solicitation for gunnery training systems, contending that the: (1) awardee's bid was nonresponsive, since it failed to include the price of one of the required systems; and (2) Navy improperly waived the awardee's omission of the price of a material requirement. GAO held that the: (1) awardee's price omission did not render its bid nonresponsive, since it involved an item that the Navy erroneously included on the schedule; and (2) Navy properly determined that the awardee's bid satisfied its needs and that award under the defective solicitation did not prejudice other bidders. Accordingly, the protest was denied.
