A university and a firm protested a Defense Logistics Agency (DLA) contractor's subcontract award to another firm for training services, contending that the contractor failed to follow its evaluation procedures in awarding the subcontract. GAO held that the: (1) contractor improperly used undisclosed criteria in its proposal evaluation; (2) contractor improperly offered to provide free services to the awardee and not to other offerers; and (3) protesters were entitled to recover their bid and protest preparation costs if contract termination would not be feasible. Accordingly, the protests were sustained.
