A firm protested the Army's: (1) rejection of its low bid for maintenance stone, contending that the Army should not have set aside the procurement for small businesses, since two of the three bidders mistakenly certified themselves as small. GAO held that the: (1) protester untimely filed its allegation; (2) Army improperly set aside the procurement; and (3) number of small businesses that responded to the solicitation did not affect the propriety of the Army's initial decision to set aside the procurement. Accordingly, the protest was dismissed.
