A Vietnamese refugee requested reconsideration of his claim for unpaid rental fees arising from his lease of property to the Army in Vietnam. GAO had held that: (1) the claim was time-barred; and (2) even if the claim was not barred, the claimant failed to establish the government's liability. In his request for reconsideration, the claimant contended that: (1) a government official recalled that the lease may have continued until the Army withdrew from Vietnam; and (2) the Army did, in fact, use the land until it withdrew from Vietnam. GAO held that: (1) the claim was time-barred because the claimant filed it more than 6 years after it first accrued and first sued the government more than 9 years after it first accrued; and (2) the claimant failed to present sufficient evidence to support his claim. Accordingly, the denial was affirmed.
