A firm protested a Navy contract award, contending that the awardee: (1) misled the Navy in its proposal; (2) would use less qualified personnel than necessary; and (3) would violate the Service Contract Act's wage requirements. GAO held that: (1) whether the awardee could perform the contract was a matter of responsibility, which it would not review; (2) the Department of Labor had sole authority to enforce the act; and (3) it would not consider contract enforcement and performance, as they were matters of contract administration. Accordingly, the protest was dismissed.
