[Protest of DLA Contract Award for Surgeons' Gloves]

A firm protested any Defense Logistics Agency (DLA) contract award to another bidder for surgeons' gloves, contending that: (1) DLA improperly rejected its bid as nonresponsive for failure to meet the requirements of the Buy American Act and the Trade Agreements Act; and (2) since the awardee offered a domestic end product, its bid was not in compliance with the Trade Agreements Act. GAO held that: (1) DLA properly found the protester's bid nonresponsive, since its foreign end product was not from a designated country and its bid exceeded the price limit under the Trade Agreements Act; and (2) the Trade Agreements Act did not prohibit the acquisition of domestic end products in applicable procurements, since its intent was to place designated foreign countries' end products on an equal footing with domestic end products. Accordingly, the protest was denied.
