A firm requested reconsideration of a decision concerning two Army solicitations for parachutes. The protester had contended that the solicitations were inconsistent with the requirements for multiyear contracts. GAO had held that the solicitations dealt with requirements contracts and were not subject to multiyear contract requirements. In its request for reconsideration, the protester contended that: (1) the Army failed to provide realistic estimates of the total quantity of parachutes needed; and (2) its suppliers' statements that they would not make long-range price commitments constituted clear and convincing evidence that the Army's choice of a contract format was arbitrary. GAO held that: (1) the Army properly used a requirements contract rather than a fixed-quantity contract, since it was uncertain as to how many parachutes it would need; and (2) it would not question the Army's determination concerning the best method of accommodating its minimum needs, absent a showing that the decision was arbitrary or unreasonable. Accordingly, the original decision was affirmed.
