A firm protested a proposed Defense Construction Supply Center (DCSC) contract award for vertical bow staves, contending that the awardee was: (1) not responsible and lacked the equipment, expertise, and financial capability to perform; and (2) ineligible under the Walsh-Healey Act. GAO held that: (1) it would not consider the matter of the awardee's responsibility absent evidence that the contracting officer acted fraudulently, illegally, or in bad faith; (2) it would not consider the awardee's status under the act; and (3) DCSC should rectify its failure to refer the matter of the awardee's eligibility under the act to the Small Business Administration. Accordingly, the protest was dismissed in part and denied in part.
