A firm protested the Veterans Administration's (VA) rejection of its bid under a solicitation for diagnostic substances, reagents, and test sets, contending that: (1) a specification requiring offerers to show that their anticipated sales under the contract would total $25,000 was ambiguous; and (2) VA improperly rejected its bid for failure to meet the sales retention threshold requirements. GAO held that: (1) the protester untimely filed its protest concerning the alleged solicitation defect; and (2) VA properly rejected the bid, based upon sales records which showed that the protester did not meet the minimum sales requirement. Accordingly, the protest was dismissed in part and denied in part.
