The Defense Logistics Agency requested a decision concerning the entitlement of three employees to night differential pay for overtime hours they worked between 1977 and 1983. GAO held that: (1) it would not consider the claims concerning time worked before March 1980, since statutory law barred GAO consideration of claims more than 6 years after the first accrual date; (2) filing the claim with any other government agency did not satisfy the requirement to file with GAO; and (3) since the claimants' work was not predictable enough to allow DLA to schedule their hours in advance, they were not entitled to night differential pay. Accordingly, the claim was denied.
