Highlights

A firm protested the Army's decision to exercise a contract option for an additional quantity of electronic bomb fuzes, contending that the Army violated a regulation concerning contract options. GAO held that: (1) the protester misconstrued the applicable regulations; (2) the Army properly based its decision to exercise the contract option on prices available under existing contracts with the protester and the awardee; and (3) the Army reasonably assumed that the awardee had the lowest price for additional fuzes. Accordingly, the protest was denied.
