In response to a congressional request, GAO commented on the applicability of the Buy American Act to a Canadian proposal to sell sand to the Army Corps of Engineers. GAO concluded that: (1) the sand was a construction material under the act's provisions; (2) a waiver under the act would not be automatic; and (3) to grant a waiver, the head of the Corps must determine that one of the act's statutory exceptions is applicable.
