A firm protested a Department of Energy (DOE) contract award for forklift trucks, contending that the items the awardee offered in its descriptive literature were not in compliance with the solicitation's requirements. DOE contended that the protester was not sufficiently interested to protest because its descriptive literature was defective, rendering its bid nonresponsive. GAO held that: (1) it would consider the merits of the protest, because the protester contended that the awardee's bid was nonresponsive for the same reason that DOE rejected its bid; and (2) the contention concerning the awardee's descriptive literature was without merit, because the items the awardee offered were in compliance with the solicitation specifications required. Accordingly, the protest was denied.
