A firm protested a Navy contract award for spectrometric oil analysis, contending that: (1) the Navy failed to follow its own internal procedures in issuing the solicitation; and (2) the awardee was nonresponsible because it did not have the necessary equipment, personnel, or facilities to perform the contract properly. GAO held that it would not consider: (1) an agency's alleged failure to follow its internal procedures, since that was a matter for agency consideration; and (2) an agency's determination of responsibility absent a showing of fraud or bad faith or that the agency failed to apply definitive responsibility criteria. Accordingly, the protest was dismissed.
