Highlights

A firm protested a Navy contract award to another firm for a radiological liquid storage facility, contending that the awardee's bid was nonresponsive since it failed to include a properly executed bid guarantee. GAO held that the failure to disclose outstanding bond obligations: (1) did not render the bid nonresponsive since the bid was otherwise proper; and (2) was a matter of responsibility, which must be established prior to contract award. Accordingly, the protest was dismissed.
