A firm protested the terms of a Veterans Administration (VA) solicitation to supply and service oxygen concentrators and cylinders at VA beneficiaries' homes. The protester contended that the solicitation: (1) discriminated against small businesses; and (2) unduly restricted competition by combining statewide services into a single contract. GAO held that: (1) the fact that a specification precluded a particular firm or class of vendors from the competition did not make the specification unduly restrictive; and (2) it would not question the VA determination to procure the services statewide, since small businesses submitted the three low bids. Accordingly, the protest was denied.
