A firm protested an Army contract award for electrical repairs, contending that: (1) the Army should reject the three low bids since the firms were not small business concerns; (2) the Army improperly proceeded with award after receiving its size-status protest; and (3) it timely filed its size-status protest by telephone within 5 working days after bid opening and sent a subsequent written protest within the same period. GAO held that: (1) the protester timely filed its agency-level protest within 10 days after it knew the basis for protest; (2) the protester untimely filed its protest with GAO more than 10 working days after the Army denied its agency-level protest; and (3) the Army properly awarded the contract, since the protester failed to timely file its written size-status protest. Accordingly, the protest was dismissed.
