The Marine Corps requested a decision concerning whether a member was entitled to a variable housing allowance for a 7-day period in a high housing cost area. GAO noted that the member elected to stay in the area rather than at his permanent duty station while in a leave status awaiting his final discharge. GAO held that, since he maintained his permanent duty station until the time of his discharge and the Corps did not assign him to duty at another station, his leave-taking did not create an entitlement to a variable housing allowance. Accordingly, the Corps should deny the claim for variable housing allowance.
