[Request for Reconsideration of Decision Concerning Army Solicitation]
Highlights
A firm requested reconsideration of a decision which partially denied and partially dismissed as untimely its protest against an Army contract award for decontaminating apparatuses. GAO had held that: (1) a portion of the protest concerning the Army's alleged disclosure of the protester's bid price was untimely filed more than 10 days after the protester learned the basis for protest; and (2) the protester failed to prove its allegations that the Army delayed a contract award to it under a similar solicitation in order to damage its competitive position under the instant solicitation. In its request for reconsideration, the protester contended that: (1) the basis for protest arose shortly before it filed the protest; and (2) it had not protested in regard to the other solicitation. GAO held that: (1) the protester presented no new evidence that would warrant reconsideration; and (2) given the protester's contention that it did not protest the other solicitation, there was no reason to further consider the matter. Accordingly, the original decision was affirmed.
