[Request for Reconsideration of Claims Group's Denial of Request for Debt Waiver]

A federal employee, transferred from the Federal Aviation Agency (FAA) to the Bureau of Land Management (BLM), requested reconsideration of the Claim Group's denial of his application for waiver of his debt due to erroneous payments he received after he converted from a wage grade position to a general schedule position and BLM determined his pay using erroneous wage grade rates. GAO has held that an employee is not entitled to relief when he is aware of a salary overpayment. GAO determined that: (1) the employee accepted in good faith overpayments he received before FAA notified him of the error; and (2) after such notification he should have been aware of the possibility of a continued error in his pay. Accordingly, the Claim Group's denial was sustained.
