In response to a congressional request, GAO considered the applicability of a statute for the temporary filling of vacant positions to officers of the Department of Health and Human Services serving in an acting capacity without Senate confirmation. GAO determined that those officers who have served more than 30 days in an acting status were in violation of the statute.
