A firm requested reconsideration of the dismissal of its protest against a Navy prime contractor's subcontract award. GAO dismissed the protest because the prime contractor was not operating a government-owned facility and was not serving as a conduit between the government and the subcontractor. In its request for reconsideration, the protester contended that: (1) the decision was inconsistent with a previous GAO decision; (2) GAO erroneously based its determination on the Navy's failure to follow its internal procedures on government-owned, contractor-operated facilities (GOCO); and (3) the Navy's contract-required management services. GAO found that: (1) the previous decision was not applicable to the instant protest, since that decision involved a GOCO; (2) the Navy did not regard the prime contractor as a GOCO; and (3) the Navy's contract did not indicate that the prime contractor was principally responsible for management services. Accordingly, the prior decision was affirmed.
