A firm requested reconsideration of the dismissal of its protest against an Army contract award. GAO noted that the protest was dismissed because the protester did not file its written comments on the agency report or state a continued interest in the protest within 7 days after it received the report. GAO has held that: (1) it will close a protest file if a protester fails to comment on the agency report within the prescribed timeframe; (2) protesters are charged with constructive notice of bid protest regulations since they are published in the Federal Register; and (3) since the protester did not file its comments within the prescribed 7-day period, the protest was properly dismissed. Accordingly, the prior decision was affirmed.
