Pursuant to a congressional request, GAO reconsidered its determination that two Department of the Treasury accounts are subject to sequestration under the Balanced Budget and Emergency Deficit Control Act. The two accounts are receipt accounts for: (1) customs taxes collected in Puerto Rico; and (2) excise taxes on goods produced in Puerto Rico for domestic consumption. The funds are permanent indefinite appropriations from which the Treasury makes payments to Puerto Rico. GAO held that: (1) the two funds are not specifically exempted from the act's provisions; and (2) a blanket exemption pertaining to trust funds applies to payments to trust funds, not payments from trust funds. Accordingly, GAO affirmed its determination that payments from the two accounts are subject to sequestration under the act.
