A firm requested reconsideration of the dismissal of its protest against the Defense Logistics Agency's rejection of its bid as late. GAO dismissed the protest because it was not filed within 10 working days after the protester knew of initial adverse agency action. In its request for reconsideration, the protester contended that: (1) it had filed its protest within 10 working days after any contracts were awarded; and (2) it delayed its protest to GAO because it was still pursuing the matter with the contracting officer. GAO has held that the fact that a protester continues to pursue a denied protest with the contracting agency does not alter bid protest timeliness requirements. Accordingly, the prior decision was affirmed.
