In response to a congressional request, GAO commented on a suggestion to amend the late bid provision in the procurement regulations to exclude the consideration of late bids sent by certified mail in order to eliminate the possibility of bidders mailing bids or modifications after bid opening and using certified mail to show that they were mailed before bid opening. GAO: (1) recognized the possibility that a bidder using certified mail might be able to subvert the system by obtaining a postmark on the receipt but not on the envelope; and (2) approved of a proposed change to require a double postmark.
