A motor carrier requested review of the General Services Administration's (GSA) audit action which denied its bill for detention charges on a shipment it transported for the Navy. The Navy advised the carrier in advance that the destination facility would be closed for a holiday, but the carrier delivered the shipment on the last day the facility was open and left its trailer at the facility because the Navy could not immediately unload it. The carrier contended that the Navy advised it to leave the trailer; however, the Navy alleged that the carrier left the trailer for its own convenience. The carrier subsequently billed the Navy for detention charges for the holiday period during which the trailer remained at the destination facility. GAO held that: (1) it would accept the Navy's version of events because the facts of the case were sharply disputed and the carrier provided no evidence on the case other than its own statements; and (2) GSA properly disallowed the detention charges because the carrier left the trailer for its own convenience. Accordingly, the GSA audit action was affirmed.
